Age and ID requirements.

In New Mexico, earlobe piercings are exempt from the standard requirement for parental presence, meaning minors can often get them without a parent present. For all other body piercings (including cartilage, navel, and facial piercings), a parent or legal guardian must be physically present to provide written consent and prove their identity.

Age Requirements by Piercing Type:

  • Under 13 years old: Only earlobe piercings are permitted (typically 18, 16, or 14 gauge only), and the minor must be able to verbally consent and understand aftercare instructions.

  • 13 to 17 years old: Clients may receive earlobes, ear cartilage, navel, facial, and oral piercings, provided a parent or legal guardian is present with valid identification.

  • 18 years or older: No parental consent is required; a valid government-issued photo ID is sufficient.

Documentation Requirements for Minors: Recent updates to New Mexico body art regulations mandate strict verification of the guardian's identity, the minor's identity, and the legal relationship between them. Studios require two forms of ID:

  • Minor's ID: A valid photo ID (School ID, State ID, or Passport) is mandatory; if the child is under 13 without a photo ID, acceptable alternative documentation must be confirmed with the studio.

  • Linking Document: An original document proving the relationship, such as a Birth Certificate, Court Order, Tax Documentation, School Registry, or Insurance Card listing both names.

  • Guardian's ID: A valid, unexpired, government-issued photo ID (digital copies are not accepted).

Genital piercings are strictly prohibited for minors under any circumstances, and nipple, surface, and dermal piercings are restricted to individuals 18 years or older.

In Texas, ear lobe piercings are generally allowed for individuals of any age, but other ear piercings (such as cartilage or nostrils) require the client to be at least 13 years old. Regardless of the piercing type (except for earlobes), minors under 18 must have a parent or legal guardian present during the procedure to provide written consent and verify their relationship to the minor.

The specific age thresholds and requirements generally follow these guidelines:

  • Ear Lobes: No strict minimum age is set by state law, though many studios set a minimum of 6 months old.

  • Nostril and Other Ear Piercings: Clients must be at least 13 years old.

  • Parental Presence: A parent or guardian must be physically present, provide a valid government-issued photo ID, and present proof of guardianship (such as a birth certificate, custody papers, or adoption documents).

  • Documentation: The parent/guardian must sign an affidavit affirming their guardianship; notarized consent is an alternative if the parent is not physically present, though most studios require physical presence.
